Vic: Man moves to change fatigue driving law -report
A man whose wife was killed by a driver who had fallen asleep at the wheel has reportedlycalled for changes to the law that allowed him to walk free.
The Saturday Herald's reported that Sun Mont Albert architect ARPAD GEMES also wantsa review of County Court judge LIZ GAYNOR's decision to direct the jury to acquit theyoung driver.
The court heard ASHLEY MARRIOTT hadn't slept for 25 hours before the crash, and hadbeen to an all-night rave party near Bolte Bridge.
KATHRYN GEMES, aged 49, was crushed to death while strolling with her husband on thefootpath near Whitehorse Rd, Mont Albert on Melbourne Cup day, 1999.
The vehicle veered across a lane and mounted the footpath before crashing into the couple.
MARRIOTT was acquitted last November when Judge GAYNOR told the jury there was insufficientevidence to support the contention he knew he was in danger of falling asleep at the wheel.
Mr GEMES has written to Attorney-General ROB HULLS and Director of Public ProsecutionsPAUL COGHLAN urging legislative changes.
